Welcome to Golf TotalGuide. These Terms of Service ("Terms") govern your use of the website at totalguide.net, the Golf TotalGuide iOS application, and related services (collectively, the "Service") operated by TotalGuide, LLC ("TotalGuide," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements. We do not knowingly collect personal information from children under 13 in compliance with COPPA.
2. Account Registration
Accounts are created and managed in the Golf TotalGuide iOS application. The website at totalguide.net is a free, public information site — it does not require or offer an account or login. When you create an account in the app, you agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@totalguide.net if you suspect unauthorized access.
3. Description of Service
Golf TotalGuide provides golf course information, AI-powered course recommendations, golfer profile matching, trip planning tools, weather data, and related content. The website at totalguide.net is a free, public information site and does not require an account. All personalized and interactive features — course matching, AI chat, saved courses, trip planning, and the Plan tab — are provided through the Golf TotalGuide iOS application, which is free to download but requires an active paid subscription that begins with a free trial (currently 1 month — an introductory offer whose length may change; the current offer is always shown on the App Store purchase screen). See Section 5 for subscription details.
Which sections apply to you. The website at totalguide.net provides promotional content, blog articles, and course and tournament information, and is free to use with no account. The subscription, in-app-purchase, AI-chat, and app-feature provisions of these Terms — including Sections 4 (AI-Powered Features) and 5 (Subscriptions & Payments) — apply only to your use of the Golf TotalGuide iOS application. If you use only the website, those app- and subscription-specific sections do not apply to you; the remaining provisions — such as acceptable use, intellectual property, disclaimers, and limitation of liability — still govern your use of the Service.
Redeemable offers and coupons. The app may display redeemable offers or coupons relating to third-party golf courses. TotalGuide is not the merchant, may or may not have a direct relationship with a given course, and does not guarantee that any course will honor an offer. Offers are shown for convenience only; their terms, availability, and expiration rest with the course, and any goods or services are provided by the course, not by TotalGuide. Redeeming an offer is solely between you and the course, and you should direct any dispute to the course. We make no warranty regarding any offer and may add, modify, or remove offers at any time.
4. AI-Powered Features
The Service uses artificial intelligence to generate course recommendations, match scores, and conversational responses. AI-generated content is provided for informational purposes only and may contain inaccuracies. You should independently verify any information before making decisions based on it. TotalGuide does not guarantee the accuracy, completeness, or reliability of AI-generated content.
Chat conversations may be stored to maintain your conversation history and improve the Service. We retain your chat logs for as long as your account is active — we do not delete them on a fixed schedule. You may request deletion of your chat history at any time by contacting support@totalguide.net or by deleting your account, in which case it is removed within 30 days.
Usage limits. To ensure fair access for all users and to manage the operating costs of the underlying AI services, we apply usage limits to the AI chat and related AI features. These limits may include caps on the number of messages and the amount of AI processing permitted in a given time period (for example, per minute, per hour, and per day), and they may differ between signed-in and anonymous users. We may change these limits at any time, and we may throttle, temporarily restrict, or suspend access to the AI features for usage that is excessive, automated, or that we reasonably believe is abusive. Reaching a usage limit does not entitle you to any refund.
5. Subscriptions & Payments
Website (totalguide.net): A free, public information site. No account and no payment are required.
iOS application: Free to download, but an active subscription is required to use the app. Every new subscriber starts with an introductory free trial (currently 1 month; offer length may change); after the trial, the subscription is required for continued access. Features include course browsing and search, AI chat, golfer-profile matching, saved courses, trip planning, and the Plan tab (hole-by-hole satellite views, slope data, target lines, and shot dispersion).
Plans available at launch:
- TotalGuide Northeast — $19.99 / year. Full access to the TotalGuide app for Massachusetts, Rhode Island, Vermont, and New Hampshire.
Additional subscription tiers covering more or fewer states or regions may be added in the future, and pricing may vary depending on the coverage a tier includes. When new tiers become available, you will be able to upgrade or downgrade within the App Store, and Apple will handle prorated billing automatically.
Free trial. Every new subscriber receives an introductory free trial (currently 1 month; this promotional offer may change — the current terms are always shown on the App Store purchase screen). You will not be charged until the trial ends. You can cancel any time during the trial in iOS Settings → your Apple ID → Subscriptions, and you will not be billed.
Automatic renewal. Your subscription automatically renews at the end of each annual term unless you turn off auto-renew at least 24 hours before the renewal date. Your iTunes account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal in your account settings in the App Store.
Billing. All payments are processed by Apple through your Apple ID in accordance with Apple's Terms and Conditions. TotalGuide does not see or store your payment information.
Refunds. All refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com or follow the steps in iOS Settings → your Apple ID → Subscriptions.
Price changes. If we change the price of an existing subscription, you will be notified before the change takes effect and may choose to cancel rather than renew at the new price.
6. User Content
You may submit reviews, ratings, and other content ("User Content") to the Service. You retain ownership of your User Content but grant TotalGuide a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely for the purpose of operating and promoting the Service. This license is revocable upon deletion of your content and will terminate within thirty (30) days of deletion, except for copies retained in routine backups that are overwritten in the ordinary course of business.
Content Standards: User Content must not be defamatory, obscene, fraudulent, misleading, or in violation of any law. We reserve the right to moderate, reject, or remove User Content at our discretion. You may appeal content moderation decisions by contacting support@totalguide.net.
Ratings: Star ratings may be updated when submitting or editing a review. Text reviews are subject to moderation and must meet our community guidelines.
7. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Submit false, misleading, or fraudulent reviews or information
- Use automated tools, bots, scrapers, or crawlers to access, collect, or extract data from the Service
- Use any content from the Service to train, fine-tune, or develop artificial intelligence or machine learning models without our express written consent
- Reproduce, redistribute, or create derivative works from Service content without authorization
- Circumvent any rate limiting, access controls, or security measures
- Impersonate another person or entity
8. Intellectual Property
All content on the Service — including but not limited to text, graphics, logos, images, data compilations, course analyses, vector embeddings, AI-generated content, software, and design — is the property of TotalGuide, LLC or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws.
You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from the Service without our prior written consent. This prohibition explicitly includes the use of Service content for training, developing, or improving any artificial intelligence system, machine learning model, large language model, or similar technology.
9. Data Scraping & Automated Access
You may not use any automated means — including robots, spiders, scrapers, data mining tools, or any similar technology — to access, monitor, copy, or collect data from the Service. This includes accessing APIs in an unauthorized manner. Any unauthorized automated access constitutes a violation of these Terms and may also violate applicable law, including the Computer Fraud and Abuse Act.
10. Third-Party Services
The Service may contain links to third-party websites, services, or content (including golf course websites, booking platforms, and map services). TotalGuide does not endorse or assume responsibility for any third-party content or services.
Stay & Play trips and packages. The Service may link to stay-and-play golf trips and travel packages offered by independent third parties. TotalGuide has no relationship, affiliation, or agreement with these providers and does not operate, sell, endorse, or guarantee any trip, package, booking, or price. Any booking or purchase is solely between you and the third-party provider under that provider's own terms; TotalGuide is not responsible for the trip, any payment, cancellation, or refund, or the provider's performance.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TOTALGUIDE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Golf course information, ratings, scores, recommendations, and AI-generated content are provided for informational purposes only. We do not guarantee the accuracy, timeliness, or completeness of any information on the Service.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTALGUIDE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless TotalGuide and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
15. Dispute Resolution
Binding Arbitration: Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Massachusetts.
Class Action Waiver: You agree to resolve disputes with TotalGuide on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.
Small Claims Exception: Either party may bring an individual action in small claims court if the dispute qualifies.
Opt-Out: You may opt out of the arbitration provision by notifying us in writing within 30 days of creating your account at support@totalguide.net.
16. Force Majeure
TotalGuide shall not be liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, cyberattacks, government actions, utility failures, or internet outages.
17. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of account termination by contacting support@totalguide.net.
You may permanently delete your account at any time from the Account screen in the iOS application by tapping "Delete account." You may also request account deletion by email at support@totalguide.net. Upon deletion, we will remove your personal data — including your profile, saved courses, trip plans, quiz results, and chat history — in accordance with our Privacy Policy, subject to any legal retention requirements. If you have an active iOS subscription, your access continues through the end of the current billing period; subscription cancellation is handled by Apple in iOS Settings → your Apple ID → Subscriptions.
18. Changes to These Terms
We may update these Terms from time to time. For material changes, we will provide notice within the Golf TotalGuide iOS app, and by email where we have your email address, before the changes take effect. Continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
19. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles.
